Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Dracix eSIM service ("Service") operated by Honeybank Studios Ltd, a company registered in England and Wales ("Company", "we", "us", or "our").
By purchasing or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Service Description
Dracix provides data-only eSIM profiles that enable internet access within mainland China. The Service routes traffic through direct ISP peering infrastructure — it is not a VPN, proxy, or anonymity service.
2.1 Coverage
The Service operates in mainland China only. It does not cover Hong Kong, Macau, or Taiwan — these regions have their own unrestricted internet access.
2.2 Data-Only Service
The eSIM provides data connectivity only. Standard voice calls and SMS are not included. You must retain your existing SIM for phone number functionality.
2.3 Temporary Travel Use Only
The Service is designed exclusively for temporary travellers visiting our coverage areas. It is not intended for permanent or long-term residential use. By purchasing the Service, you confirm that you are a traveller and not a permanent resident of mainland China using the Service as a primary means of internet access.
2.4 Customers Based in China
We do not accept customers who are based in or are permanent residents of mainland China. Purchasing or using the Service while ordinarily resident in mainland China is a breach of these Terms and may contravene local regulations. If we determine that a customer is based in mainland China, we reserve the right to terminate the Service immediately without refund.
2.5 Extended Use Limitation
Any eSIM that remains continuously connected to a network within our coverage area for more than six (6) consecutive weeks may be disconnected without prior notice. This limit exists to ensure the Service is used in accordance with its intended purpose as a temporary travel product. If you require connectivity beyond six weeks, please contact us at support@dracix.com or via the live chat button in the bottom right of our website before your limit is reached to discuss your options.
2.6 Device Compatibility
The Service requires an eSIM-compatible device. You are responsible for confirming your device supports eSIM before purchase. A non-exhaustive list of compatible devices is provided on our website for reference only — we do not guarantee compatibility with every device model.
3. Plans and Pricing
3.1 Plan Types
We offer the following plan types, subject to availability:
- Standard (Care-Free): A daily data allowance at full speed, with reduced speed after the daily allowance is reached. The daily allowance resets at midnight UTC.
- Pro (Care-Free): A higher daily data allowance at full speed, with reduced speed after the daily allowance is reached. The daily allowance resets at midnight UTC.
- Pay-As-You-Go: Charged per gigabyte with no daily reset. Service pauses when balance is depleted until a top-up is made.
3.2 Throttling
On daily plans, once the daily allowance is consumed, speeds are reduced (not suspended) for the remainder of that day. Specific speed limits and daily allowances are displayed on the relevant plan page at the time of purchase.
3.3 Pricing
All prices are displayed in British Pounds Sterling (GBP) and are inclusive of any applicable taxes. Prices are subject to change; however, any price change will not affect orders already placed and paid for.
4. Ordering and Payment
4.1 Account Registration
You must create an account to purchase the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4.2 Payment
Payments are processed securely through Mollie, a PCI-compliant payment provider. We do not store your payment card details. Full payment is required at the time of purchase before the eSIM profile is delivered.
4.3 Order Confirmation
Upon successful payment, you will receive an order confirmation and your eSIM installation details will be available immediately via your account dashboard.
5. eSIM Delivery and Activation
5.1 Delivery
eSIM profiles are delivered digitally and instantly after payment is confirmed. There is no physical shipment for eSIM orders.
5.2 Installation
You may install your eSIM via universal link, QR code, or manual entry. Detailed instructions are provided in your account dashboard after purchase.
5.3 Pre-Arrival Installation
You must install the eSIM before arriving in mainland China. The QR code and installation links may not be accessible from within China's network. We are not responsible for installation failures caused by attempting to install after arrival.
5.4 Service Period
Your service period begins on the start date selected during checkout and runs for the number of days purchased. Daily data allowances reset at midnight UTC (08:00 CST).
6. Refund Policy
6.1 Eligibility
You are entitled to a full refund if your total data usage on the eSIM is less than 1 GB. Refund requests must be submitted by contacting us at support@dracix.com or via the live chat button in the bottom right of our website.
6.2 Ineligibility
No refund will be issued if you have consumed 1 GB or more of data on the eSIM profile associated with the order. Partial refunds are not available.
6.3 Processing
Approved refunds will be processed to the original payment method within 10 business days. The eSIM profile will be deactivated upon refund.
7. Acceptable Use
7.1 Permitted Use
The Service is provided for lawful personal internet use. You may browse the web, use messaging applications, stream media, make video calls, and conduct other standard online activities.
7.2 Prohibited Use
You must not use the Service to:
- Engage in any activity that is illegal under UK or Chinese law;
- Use the Service while ordinarily resident in mainland China, or as a substitute for a domestic internet connection;
- Distribute malware, spam, or conduct denial-of-service attacks or other network abuse;
- Resell, redistribute, or share the eSIM connectivity with commercial intent;
- Attempt to reverse-engineer, modify, or tamper with the eSIM profile or our network infrastructure;
- Use the Service in a manner that degrades performance for other users or exceeds reasonable personal usage patterns.
7.3 VPN Usage
Running a third-party VPN simultaneously with the Service may cause connectivity issues. We do not provide support for problems arising from concurrent VPN use.
7.4 Suspension
We reserve the right to suspend or terminate your Service without notice if we reasonably believe you are in breach of these Terms. No refund will be provided in such cases.
8. Service Availability and Limitations
8.1 No Guarantee of Availability
While we aim to provide reliable connectivity, we do not guarantee uninterrupted or error-free service. Network performance depends on carrier infrastructure, location, device capability, network congestion, and other factors beyond our control.
8.2 Speed Estimates
Speeds advertised on our website are real-world estimates, not guaranteed minimums. Actual speeds vary based on network conditions, time of day, location, and device.
8.3 Carrier Network Changes
The Service relies on third-party carrier networks (China Mobile, China Unicom, and China Telecom). Changes to these carriers' networks, policies, or infrastructure may affect the Service. We are not liable for disruptions caused by carrier-level changes.
8.4 Regulatory Changes
The Service operates within a complex regulatory environment. Changes in law or regulation in any relevant jurisdiction may affect service availability. We will make reasonable efforts to notify you of material changes but are not liable for disruptions caused by regulatory action.
9. Intellectual Property
All content on the Dracix website, including text, graphics, logos, and software, is the property of Honeybank Studios Ltd or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
10. Limitation of Liability
10.1 Service Limitations
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of revenue, or business interruption.
10.2 Maximum Liability
Our total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid for the specific order giving rise to the claim.
10.3 Consumer Rights
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
11. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
